AOVIEW Terms of Service V2.1

Please read these Terms carefully. By affirmatively accepting them or using AOVIEW after acceptance, you agree to these Terms. Our processing of personal information is governed separately by the AOVIEW Privacy Policy.

1. The Service

AOVIEW provides compatible smart-camera account management, device setup and binding, live view, two-way audio, access to recordings stored on a device, event viewing, alerts, device sharing, settings, diagnostics, help, and support. Availability depends on device model, firmware, network, operating system, permissions, region, and app version. A description in these Terms does not promise a feature that is not available in the released app.

2. Eligibility and Accounts

You must be legally capable of agreeing to these Terms in your location. If you use AOVIEW for an organization, you represent that you are authorized to do so. You are responsible for protecting passwords, verification codes, signed-in devices, and camera access. Notify us promptly of suspected unauthorized access.

3. Devices, Installation, and Lawful Use

You must have the right to bind and control each device. Install and use cameras in compliance with applicable privacy, surveillance, audio-recording, employment, housing, and data-protection laws. Where required, provide notices or obtain consent from visitors, neighbors, employees, household members, and others who may be recorded.

Do not place a camera where recording is prohibited or where a person reasonably expects privacy. AOVIEW is not an emergency response, fire, medical, or professionally monitored security service. Do not rely on the app as the sole means of protecting life or property.

4. Camera Content

You are responsible for the lawful capture, viewing, storage, export, disclosure, and deletion of video, audio, images, event snapshots, and recordings accessible through your devices. You retain rights you lawfully hold in that content. You must not use AOVIEW to violate privacy, publicity, intellectual-property, or other rights.

5. Device Sharing

Share access only with trusted people and grant the least access needed. Shared users may view content, receive alerts, or perform actions shown in the app. Review and revoke access when it is no longer needed. You are responsible for sharing decisions and for having a lawful basis to disclose camera content, except to the extent applicable law places responsibility on us.

6. Alerts and Availability

Alerts and connectivity can be affected by camera power, storage media, cellular or local networks, carriers, P2P or relay infrastructure, operating-system notification channels, battery-saving settings, third-party services, and permissions. Alerts may be delayed, duplicated, or not delivered. We use reasonable efforts to maintain the Service but do not promise uninterrupted connectivity, continuous video, perfect detection, or loss-free recordings.

7. Acceptable Use

You may not access another person's account or device without authorization; defeat security controls; reverse engineer except where law permits; introduce malicious code; overload or disrupt systems; collect or distribute content unlawfully; or use the Service for harassment, fraud, surveillance abuse, or other illegal conduct.

If we reasonably identify a serious security, legal, or abuse risk, we may restrict affected functionality, suspend access, block abnormal connections, preserve legally necessary records, or cooperate with authorities. Where reasonably possible and legally permitted, we will provide notice and a way to contact us.

8. Software, Firmware, and Third-Party Services

We or device technology providers may issue app, firmware, security, or configuration updates. Hardware, firmware, P2P connectivity, relay services, carrier networks, system notifications, app stores, and infrastructure may be provided by third parties. Their acts, outages, compatibility changes, and geographic limits may affect the Service and are not fully within our control.

9. Changes and Discontinuation

We may modify the Service for security, legal compliance, compatibility, maintenance, or operational reasons. We will use reasonable methods to communicate material changes. We may discontinue a feature or the Service where reasonably necessary, subject to applicable law. You may stop using AOVIEW and request account deletion.

10. Intellectual Property

AOVIEW software, interfaces, documentation, branding, and related materials are owned by the service provider or licensors. These Terms grant a limited, personal, non-exclusive, revocable right to use the app for its intended purpose. They do not transfer ownership. Rights in user content remain with the lawful rights holder.

11. Privacy

Our Privacy Policy explains how we process personal information. You are responsible for complying with applicable privacy and recording laws when installing cameras, sharing devices, and handling camera content.

12. Children

The Service is not directed to children under 13, or a higher minimum age where local law requires it. A minor may use the Service only with the involvement and permission of a parent or guardian. Camera owners remain responsible for lawful recording of children.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE DO NOT WARRANT THAT IT WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR COMPATIBLE WITH EVERY DEVICE, NETWORK, CARRIER, OR REGION. Nothing in these Terms limits mandatory warranties or consumer rights that cannot legally be excluded.

14. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for losses caused by user conduct, device hardware, storage media, networks, carriers, operating systems, third-party services, force majeure, or other conditions beyond our reasonable control.

This limitation does not apply to liability that cannot lawfully be limited, including liability arising from fraud, willful misconduct, gross negligence where applicable, death or personal injury caused by negligence, or violation of non-waivable consumer rights.

15. Termination

You may stop using the Service and request deletion of your account. We may suspend or terminate access for a material breach, unlawful use, a serious security threat, or where required by law. Where practicable and lawful, we will provide notice. Provisions that by their nature should survive termination will remain effective.

16. Governing Law and Consumer Rights

These Terms are governed by the laws of the Hong Kong Special Administrative Region. The courts of Hong Kong shall have jurisdiction over disputes arising from these Terms, except where mandatory consumer law gives you the right to bring a claim in another court or under another procedure. Nothing in this section deprives consumers of non-waivable protections in their place of residence.

17. Changes to These Terms

We may update these Terms for legal, security, product, or operational reasons. We will provide reasonable notice of material changes and obtain renewed acceptance where required. If you do not agree, you may stop using the Service and request account deletion.
